We conduct videotaped evaluation of potential witnesses, with coaching on speech, appearance and delivery. Emphasis is placed on communication and presentation skills within the context of that portion of the trial story each witness may carry.
One of the most difficult and unpredictable components of courtroom experience for trial lawyers concerns witness performance. After extensive preparation and with the belief witnesses are adequately prepared, attorneys often are shocked to find witnesses behave unpredictably on the stand. Testimony tainted by a negative personality style, intense anxiety, anger, or problem speech patterns can interfere with the juror's abilities to evaluate case facts objectively.
Even rehearsed testimony can fail to produce desired effects in court. Numerous reasons for negative courtroom behavior by a witness may directly be addressed through behavioral preparation. Anxiety is the most common element in undesirable witness presentation. Because of the courtroom's image as a place of authority, desired responses obtained in practice sessions may dissipate when witnesses give testimony or are cross-examined. Negative behavior in court may also result from ineffective practice sessions. The worst problems in testimony occur during cross-examination. A witness may be prepared to handle direct examination and does so as anticipated. However, because of the adversarial nature of the setting, opposing lawyers can intimidate witnesses, leaving them feeling angry and anxious. Effective training must occur in a realistic courtroom setting, preferably before a live jury!
